Competition and Litigation

Competition cases are not conducted in a political vacuum. This presents risks but also opportunities for parties involved in an investigation. Legal arguments may not always be sufficient to convince the authorities or mitigate the impact of its decisions. Major cases will resonate in the international media, and decisions blocking a merger or imposing a hefty fine represent reputational and financial hazards for which the parties concerned ideally will have developed an adequate response.

GPLUS has a long track record of working on the largest European antitrust, cartel and mergers, state aid and tax cases as well as trade disputes and sanctions. We work hand in glove with your law firm, economic experts and communication teams, both in Europe and globally.

Our senior advisors are well-known in the competition policy arena because of the cases they have handled and the positions they have previously occupied. GPLUS combines this first-hand expertise with a strong record in crisis communications and management.

How can we help

  • Strategic advice and political lobbying: we advise on whom to speak to and when, recommend possible coalition-building, provide background on your interlocutors and recommend how to play a meeting, convey messages to and receive feedback from the Commission, stakeholders and third parties.
  • Preparation for the Commission’s decision and its announcement: we handle expectation management, internal communications, letters to employees, to customers, media training, background press briefings, Q&A, press releases and other material.
  • Communications and media relations: we help minimise media coverage or at least ensure balanced briefing of key journalists, issue rebuttals where necessary and manage crises. By contrast, we can also devise and implement a pro-active media strategy, e.g. to lend prominence to a formal complaint or an appeal and present it in the right light.
  • Reputation management: parties to a case will often have detractors trying to undermine their position. At the same time, they need to preserve their credibility and standing, be it with the EU institutions, the media, customers or other stakeholders. We can help them sustain and enhance their reputation.
